RULES OF PROCEDURE - CONDOMINIUM PENINSULA IXTAPA

​

Set of rules and regulations of general application to condominium owners, users, employees, visitors and other persons related in any way to the CONDOMINIUM.

​

---------------- OF THE RIGHTS AND OBLIGATIONS OF THE CONDOMINIUMS. ---------------

​

1.- Each condominium owner will use his unit in a peaceful, orderly, reasonably silent and respectful manner, in accordance with the dictates of good common sense.

​

2.- No condominium owner may make use of his unit, in a way that alters the peace and comfort of the other condominium owners or endangers or alters the safety, comfort, stability, healthiness or hygiene of the property in general or in particular any of the units. Owners must refrain from actions or omissions that put them in danger of fire, theft, collapse or other damage of any kind or give rise to situations that may cause similar results.

​

3.- No condominium owner can paint or decorate the facade, doors, walls or exterior portions of his unit. 

 

I. Rules Concerning Access to the Building

For our safety, we must all cooperate to control access to the building. The fact of registering the guests, the tenants and authorizing all visitors, is the key to the security of all.

​

1.- All owners, visitors and suppliers must be registered in the security booth before being allowed into the building, the owner of the department must notify in advance of their arrival. People who do not register and present identification will be asked to leave the property.

​

2.- All the owners, co-owners and direct descendants of both, previous identification, guests and / or tenants.

​

3.- If an owner decides to offer his / her department to a specific person or family member when he / she is not present, he / she must fill out a form called "guest file" that the administration will send to each and every one of the condominium owners previously where he will write down :

• Department.

• Owner's Name.

• Arrival date.

• Departure date.

• Name of the guests and their relationship.

• Signature and authorization of the owner.

• Signature of the guest of knowledge of the Regulation.

​

4.- The guest cards must be sent to the Administration 3 days in advance, by mail and confirm receipt of the same. These cards will be registered in a "guest control" in a blog.

​

5.- The Administration will verify the number of people that enter as guests to the departments so that in case of exceeding a penalty for each exceeded person is charged, before giving the access to the department, the Owner will be informed and a note will be taken of the type of people that enter as guests to the departments to make the corresponding observation. Taking into account that the maximum number of people allowed per department of four bedrooms is 10 people, by department of three bedrooms of 8 people, by department of 2 bedrooms 6 people and by apartments of 1 bedrooms is 4 people. For the purposes of this subsection, each minor is considered as an occupant.

​

6.- The guests upon arrival must go to read, and sign the Regulations of the condominium before going up to the departments and provide them with any service.

​

7.- In case the guest shows up outside the administration hours, he will present his letter signed by the original owner at reception to give him access to the department. Afterwards, the bellboy will have to bring the letter to the office at the first hour of the following day to contact the people so that they can carry out the corresponding procedure. Otherwise you will not have the services of the staff and you will not have access to the common areas. The administrative office hours are from 9:00 a.m. at 6:00 p.m. from Mondays to Sundays.

​

8.- All visits, deliveries of furniture, furnishings, decorative items and contractors and service providers, must be authorized by the owner before being allowed access to the building and its departments and must register in Security, administration and the logs of the security personnel.

​

9.- All the people must prove their personality with the elector's credential to be able to access the condominium.

10.- Every supplier or contractor must wear a visitor's badge.

​

11.- A parking card will be available for all departments. Owners can obtain replacements for lost cards by paying a fee of $ 100.00 per card. 

 

II. Norms Concerning the Common Areas

The main common areas are the parking lot, the lobby, the elevators, the corridors, the stairs, the pool, the pool terrace, and the access to the beach.

​

1.- If any owner, guest or lessee does not carry out the corresponding identification process, they can not request services from the snack bar area.

​

2.- People are required to wear appropriate attire (t-shirt, robe over swimsuit and shoes or sandals) in the lobby, elevators, corridors and gymnasium.

​

3.- The use of the gym is not allowed for children under 14 years old, even accompanied by a responsible adult. The gymnasium can not be used by the condominium's domestic service personnel, including children's lullabies, security personnel, escorts, drivers or any other name with which they are designated.

​

3.- It is not allowed to use skates, skateboards and / or bicycles in the pool area and lobbies of the building.

​

4.- For safety, it is not allowed in any of the common areas to run, play abruptly, or dirty.

​

5.- The corridors, the stairs and the elevators must be used only to enter and exit. They should not be used for any other purpose and nothing should be left or saved in any of these places.

​

6.- All removals can only be done on weekdays between 9:00 a.m. and 5:00 p.m., preferably using the service ladder, if the furniture is too heavy. In addition, the Administration should be notified in advance and put a deposit of $ 2,000.00 to cover any damage to the building. This deposit will be refunded immediately if there is no damage. To protect the facilities, the owner or his collaborators must put a protection on the common areas in which he works and may cause damage and remove it no later than 5:00 p.m.

​

7.- No flammable, combustible, toxic or explosive substances should be kept in any unit; nor in the limited common areas that have been assigned to that department, except for those that are required for normal household chores.

​

8.- The doors of the departments that lead to the corridors should not be left open at any time. They are the sole responsibility of the owner.

​

9.- Do not leave brochures under the door of the units or in any of the common areas, except those authorized by the Administration.

​

10.- Carpets, rugs, etc. They can not be placed in the corridors outside the door of the Garden House apartments.

​

11.- Nothing can be shaken or stretched by the windows or balconies. Things placed on the balconies, (hammocks) will be subject to be authorized by the administration. The balconies can not be used as clotheslines or storage.

​

12.- No personal article should be stored in any common area of ​​the building, but in its respective department.

​

13.- All trash should be placed in tightly closed plastic bags, and these thrown away (In the area assigned by administration)

​

14.- Anything located on, hooked or projected towards the common areas will be subject to the approval of the Association.

​

15.- The outside part of the curtains, blinds and other window treatments that can be seen from outside should be uniform in white and roll-up.

​

16.- The terrace furniture should follow the white and beige tones.

​

17.- Ads can not be placed in the common areas, in the windows or in the doors of the units without the authorization of the administration.

​

18.- Every instructor, of any discipline that makes use of the facilities of the common areas and that is contracted by some owner, must be announced prior to his visit, in the administration for proof of his personal data, discipline, hours of instruction , area to use and owner to attend. So that it is clearly identified by all the personnel that work in the group. Once your instruction is finished, you must leave the facilities. And if the administration, in order to agree with the general interests of the condominium, decides to impose a schedule of instructions, it must be obeyed by the contracted instructor and the owner without exception. The instructor and, if applicable, his companions, have the obligation to identify themselves fully in the guard house with personal and non-transferable credentials. The non-demonstration of identification will be sufficient reason to deny access, without exception.

​

19.- It is forbidden the circulation of any vehicle such as ATVs, motorcycles or similar within the common areas, such as lobbies, swimming pools, gardens and any space that has been designed exclusively for pedestrian traffic. At any time this rule is violated, the security personnel will have all authority to request the exit of the vehicle.

​

20.- The only place authorized and conditioned for the parking of ATVs, motorcycles and similar vehicles is located at the bottom of the parking area specifically. In case any of the aforementioned vehicles is found in an unsuitable area, it must be removed by the owner. In case of being absent, it will be removed by the staff of the group at the discretion of the administration.

​

21.- It is not allowed that the escorts are in the common areas of the condominium.

​

22.- It is forbidden to introduce food, drinks and glassware to the pool area 

 

III. Rules Concerning the pools

​

1.- The pool is open daily from 8:00 a.m. until 10:00 p.m.

​

2.- People who use the pool do so at their own risk. The administration may employ personnel associated with the pool, will only use a lifeguard for supervision and assistance when necessary.

​

3. Children must be at least 4 years of age to use the pool. Anyone who wears diapers is not allowed in the pool. Children under the age of 12 who are in the pool area must be supervised by an adult at all times.

​

4. To ensure that all owners and their guests have fair access to the pool area, a landlord can not exceed the capacity of accommodation in their apartment. The administration reserves the right not to allow visits to the pool area on holidays or other important dates.

​

5.- It is strictly forbidden to set up beds. The towels or items used for this purpose will be removed from the beds to give place to those who need to use them at that time. Neither can the service employee sit on the bunk to set it aside.

​

6.- The use of appropriate and decorous clothing in these areas is required.

​

7. Floats, balls, toys or other objects should not be used in the pool, greater than a meter and a half in length or circumference.

​

8. To protect the pool system, sand, oils, creams, pins, hair clips and similar objects should be removed before entering the pool.

​

9. The use of the pool area is for swimming and sunbathing quietly; For other activities please use the beach. Given the location of the pool, the noise spreads easily and annoys other residents, therefore it will not be allowed.

​

10. To avoid accidents, reduce noise, it is forbidden to dive in the pool, as well as games involving running, games with balls or any other activity that is not coordinated by trained personnel.

​

11. A space for swimmers who wish to swim laps should be allowed at all times.

​

12. In order not to disturb others, people who listen to electronic devices should wear hearing aids.

​

13. Persons with a wet bathing suit are not allowed in the lobby, corridors or elevators. All people should dry well before entering the building.

​

14. It will not be allowed in the pool area, nor food, nor drinks that are not provided in the bar of consumption. Likewise, coolers, glasses, plates or glass bottles that can break and cause an accident are not allowed

​

15. Both chairs and extension chairs should be placed a minimum of four feet from the edge of the pool and can not be removed from the pool deck.

​

16.- When leaving the beach and before entering the pool area, be sure to remove all the sand from your feet.

​

17.- Security reserves the slogan of verifying the identification of the users of the pool area. Anyone who is not registered with the administration will be asked to leave the property.

​

18.- It is forbidden to use towels different from the color established by the developer. These must be white in order to identify the owners and authorized persons to use the facilities and common areas.

​

19.- It is forbidden to perform acts that attempt against morality and good customs. In any of the common areas, cots.

​

20.- It is forbidden to smoke cigars, cigars and / or pipes, eat, drink, or any other activity that is not recreation of a pool, within the family pool. As well as the prohibition to minors to carry a pipe or water shisha in the common areas.

​

21.- It is not the responsibility of the Administration any forgotten article in the common areas, however everything that is lost will be concentrated in the Administration.

​

22.- It is not allowed to organize particular events in these areas without the corresponding authorization of the Administration

23.- Any misuse or deterioration of furniture and equipment will have a cost assigned by the Administration.

​

24.- The exit to the beach is at the discretion of the owner. It is at all times your total responsibility and that of your children or companions. The administration, the lifeguard or any other personnel of the group, is not responsible for custody and surveillance of people or objects

​

25.- The awnings as the rest of the furniture of the set. They will be placed at the discretion of the administration. It assumes correct use of them. It is not allowed to separate them or occupy more than one without prior notice to the administration.

​

26.- It is forbidden for street vendors to enter the delimited area of ​​the beach. The condo owner must approach the shore if he wants to consume something.

​

27.- It is forbidden for external masseuses to enter the delimited area of ​​the beach to provide their services. To avoid this (ask the Administration to provide you with the massage menu at home)

​

28.- The beach is an area considered as Federal Zone. Due to this condition, it is foreign to the administration, any situation of risk that happens in it; robbery, violence, aggression, attack of some wild animal of the ocean etc. It is the responsibility of the visitor. Your prudence and own security are your responsibility.

​

29.- According to the legislatures in force and that apply to the Mexican littoral. It is prohibited to delimit or privatize any beach. Since all the beaches are public. It is prohibited to prevent free pedestrian traffic. The condominium is subject to the aforementioned standards and, if required by the competent authorities, must remove the fences. For this reason, it is your complete responsibility the safety of each individual who visits the beach. It is clear that it is not at any time the responsibility of the administration the safety of children or adults in the presence of motor vehicles or similar.

​

30.- It is the responsibility of the parents to allow the minors to the beach.

​

31.- Even in the presence of lifeguards, it is your responsibility to enter the sea.

​

32.- Children require supervision of an adult. The supervision of children will be strictly observed. Children must be constantly monitored by those who have an obligation to care while they are around or in the pool.

​

33.- People who use some kind of bandage will not be able to use the pool.

​

34.- Any person suffering from a skin disease, wounds, inflamed eyes, cough, cold, nasal discharge, ear infection or any other contagious disease can not use the pool. 

 

IV. Rules Concerning Bars and the Snack Bar.

​

1.- The hours in bars daily are from 11:00 a.m. at 6:00 p.m. and in holiday periods it extends from 10:00 a.m. at 7:00 p.m.

​

2.- The snack area will present two consumption letters, one for owners and guests and another for tenants, which will be charged at the stipulated cost

​

3.- Entrance to the Snack's service and service area is authorized only for the personnel assigned by the administration. 

 

V. Rules Concerning Noise

These rules are to preserve your right to enjoy peace of mind.

​

1. Disturbing noises are not allowed.

​

2. Anyone who is listening to an electronic device in the common areas, (including the lobby, the corridors, the pool area and Snack bar should use headphones.)

​

3.- With regard to the volume of appliances within the private area of ​​the department, should not disturb the other owners, if this were the case, security is entitled to ask the owner to moderate the volume of their sound devices. 

 

Norms Concerning Pets

1.- In case of entering with a pet to the condominium these must be of small breeds and must remain inside the department, and must carry it carrying out of the development to realize the physiological needs of said pet.

​

2.-It is forbidden to enter pets to common areas, swimming pools, gardens, snack bars, lobbies, walkers, and loungers. 

​

3.- In the cases that the pets make excessive noises during rest periods, they will be asked to remove it. 

​

4.- Renters are NOT permitted to bring their pets.

 

VII. Rules Concerning Parking

​

1.- Each owner must park his vehicle in the spaces assigned for that purpose.

​

2.- There are also visitor parking spaces, which, through a permit issued by the administration, may be used for employees, contractors and service providers.

​

3.- In times of high occupancy, access and use of parking to visits may be restricted by the administration. Every visitor must personally park their car in the visitor's drawers.

​

4.- It is not allowed to work on the mechanics of vehicles in the parking area, except for emergency repairs.

5.- Cars may only be washed with the supplier or person designated by the administration.

​

6.- Vehicles that leak liquids or emit smoke, are not allowed in the parking lot.

​

7.- Persons (including collaborators) who run or who drive unconsciously in the parking lot will be condemned to not parking in the parking lot or fined or both.

​

8.- Vehicles left on the access ramps to the building without permission from the administration will be towed immediately at the owner's expense.

​

9.- It is not allowed to touch the horn in the parking lot.

​

10.- No trailer, camper, boat, trailer park, trailer boat, trailer, jet ski, or commercial vehicle, may be parked in the condominium. The only exception will be the moving trucks, which will be allowed during the hours of unloading.

​

11.- Parking in front of the lobby will be for a limited purpose and for a time limit of 10 minutes to download or load passengers or objects. 

 

VIII. Standards Concerning Builders and Contractors

To protect the integrity of the building, please follow the following rules:

​

1. Any owner wishing to transform or improve their unit (beyond the painting) needs a permit from the administration, and also needs to put a deposit of $ 2,500.00 to cover possible damages to the building and its equipment, which will be returned completely from There is no harm.

​

2. All work in a unit must be done on weekdays between 9:00 a.m. and 6:00 p.m. No work is allowed on weekends or holidays.

​

3. All workers must register for security, administration and the corresponding lobby both on entry and exit and use an identification of the Administration while they remain in the building.

​

4. All contractors must submit to the administration, copies of their licenses, work permits and Certificate of Insurance.

​

5. Special materials to prevent noise should be used before putting hard surfaces on the ground.

​

6. All work done in a unit must be done inside it and not in the corridors, on the stairs or in the common areas. Building materials or any other material can be supported against the walls of the building.

​

7. The administration must approve all electrical or plumbing work that requires the cutting of supplies in which other units other than the one being worked on are affected.

​

8. Anyone who is performing construction without authorization will be suspended entry and any future work in the building. 

 

IX. Obligations of Owners

​

1.- Remembering that the period to settle the amount of maintenance fees is during the first 10 days of each quarter. When making the payment starting on the 11th of the current quarter, charges of 10% per month will be charged on unpaid balances. And the discount for annual payment is 5% during the year.

​

2.- Owners of units are responsible for any damage to the Common Areas or the Limited Common Areas caused by the owner, their relatives, guests, service personnel, agents or any other person who is on the property of the Condominium for reasons of said owner. 

 

X. Miscellaneous Rules

​

1. Employees of the administration may only be directed by their supervisor or administrator. Other Owners or residents may not direct or supervise or in any way attempt to gain any control over the employees of the administration.

​

2. The office hours in the administrative office is 10:00 a.m. at 07:00 p.m. from Monday to Sunday, in high season and from 10:00 a.m. at 6.00 p.m. from Monday to Sunday in low season. 

 

XI. Establishment of Standards, their Compliance and their Penalties.

​

1.- Any person who is in the premises of the condominium is subject to the rules established in this page.

​

2.- If any of the rules of this booklet, or part of these rules are determined as invalid, all other stipulations shall remain in force with full force and effect.

​

3.- It is the obligation of the administrator and his team to enforce these rules and to determine the existence of a violation and the amount of the fine to be imposed for violation. In case of non-compliance with the provisions of this Regulation and regardless of the penalties that may be established in the other applicable legal systems, the following penalties will be applied: - With an equivalent penalty of 1 (one) to 3 (three) times the monthly FEE in force at the time of non-compliance.

​

4.- The administration can take any appropriate legal action against any person who does not comply with the rules of the Association. The present regulation was taken according to the internal rules and on the basis of the Condominium Property Law for the State of Guerrero number 557. In case of lack thereof, the sanctions that are established according to the case will be applied. The administration reserves the right to allow the access to common areas to owners, tenants or guests that in their judgment do not meet the established.
